1. GENERAL TERMS AND CONDITIONS

1.1 Scope of Application These General Terms and Conditions apply to all contracts for the delivery of goods that a customer (whether consumer or business) concludes with Elva Care (hereinafter referred to as "Seller") through the website elva-care.com or other sales channels. The inclusion of the customer's own terms and conditions is hereby rejected unless otherwise agreed in writing.

1.2 Conclusion of Contract The presentation of products by the Seller does not constitute a binding offer, but rather a non-binding online catalog. The customer may submit a binding purchase offer (order) via the online shopping cart system. The contract is concluded only upon the Seller's order confirmation or upon delivery of the goods. Order processing is partly automated via email. The customer must ensure that the email address they have provided is correct and that receipt of emails is not blocked by spam filters.

1.3 Prices and Payment Terms All prices are displayed in US Dollars (USD). Shipping costs are additional and will be clearly displayed to the customer before order completion. Applicable sales tax will be calculated at checkout based on the customer's shipping location. The customer may choose from payment methods offered through Stripe. Payment processing is handled by Stripe Payments Europe Limited (or its US affiliate). Payments must be completed before goods are shipped unless otherwise agreed.

1.4 Delivery and Shipping Delivery is made to the address provided by the customer. Delivery times are estimates and start from the date of shipping, rather than the date of order. The Seller is not liable for delays caused by carrier delays, force majeure, or incorrect address information provided by the customer.

Shipping Estimates:

• United States: 4–12 business days (Domestic shipping)
• Canada: 6–21 business days
• International: 7–20 business days

For international shipments outside the USA, the customer is responsible for any customs duties, taxes, and import fees imposed by the destination country.

1.5 Retention of Title (Security Interest) The goods remain the property of the Seller (Elva Care retains a security interest in the goods) until full payment has been received.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ELVA CARE PROVIDES ALL PRODUCTS "AS IS" AND DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ELVA CARE DOES NOT GUARANTEE THAT THE PRODUCTS WILL MEET YOUR SPECIFIC REQUIREMENTS OR BE ERROR-FREE.

IN NO EVENT SHALL ELVA CARE, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE PRODUCTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF ELVA CARE FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE PRODUCTS, REGARDLESS OF THE FORM OF THE ACTION, IS LIMITED TO THE AMOUNT PAID BY YOU TO ELVA CARE FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.

SOME STATES DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OF CERTAIN DAMAGES, SO THESE LIMITATIONS MAY NOT APPLY TO YOU.

1.7 Product Information All product descriptions, images, and specifications are provided to the best of our knowledge. However, Elva Care does not warrant that product descriptions or other content on the site are accurate, complete, reliable, current, or error-free. Slight variations in color, size, or packaging may occur.

2. RETURN AND REFUND POLICY

2.1 Return Period We want you to be completely satisfied with your purchase. If you are not satisfied, you may return eligible items within 30 days of delivery for a refund. To be eligible for a return, your item must be unused, in the same condition that you received it, and in the original packaging.

2.2 How to Initiate a Return To initiate a return, please contact us at shop@elva-care.com with your order number and reason for return. We will provide you with instructions and a return shipping address. Please do not send your purchase back to the manufacturer without contacting us first.

2.3 Return Shipping Costs

• Defective or Incorrect Items: If you received a damaged, defective, or incorrect item, Elva Care will cover the cost of return shipping.
• Standard Returns (Change of Mind): For standard returns, the customer is responsible for paying their own shipping costs for returning the item. Shipping costs are non-refundable.

2.4 Refunds Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund. If approved, your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment within a certain amount of days.

2.5 Non-Returnable Items Certain types of items cannot be returned, such as perishable goods, gift cards, and opened personal care items (for hygiene reasons).
